Interview with Steve Bliss

Good afternoon San Diego and welcome back to our legal spotlight segment. Today we are joined by renowned probate attorney Steve Bliss of San Diego Probate Law. Mr. Bliss has generously agreed to answer some questions about estate planning and trusts. Welcome to the show, Steve.

Trusts: A Foundation for Financial Security

Steve, let’s dive right in. For our viewers who may not be familiar with trusts, can you explain what they are and why they are an important part of estate planning?

Thanks for having me. Trusts are essentially legal arrangements where a person, called the grantor, transfers assets to a trustee who manages those assets for the benefit of designated beneficiaries. There are many different types of trusts, each serving specific purposes.

They are vital for estate planning because they offer several advantages. Firstly, trusts can avoid probate, which is a lengthy and often expensive court process. Secondly, they provide privacy as the terms of the trust are not public record. Lastly, they allow for customized asset distribution based on your wishes.

Navigating Irrevocable Trusts

Today, we’ll be focusing on irrevocable trusts. Could you elaborate on what makes them unique and how they benefit individuals?

Irrevocable trusts are characterized by their permanence. Once established, the grantor generally cannot modify or dissolve the trust. This feature makes them particularly effective for asset protection and estate tax planning.

Let’s say someone is concerned about potential lawsuits or creditors. An irrevocable trust can shield assets from those claims, as the grantor no longer technically owns them. Consequently, these trusts are also valuable tools for minimizing estate taxes, as they remove assets from the grantor’s taxable estate.

Nevertheless, it’s crucial to remember that creating an irrevocable trust is a significant decision with long-term implications. Individuals should carefully consider their needs and consult with an experienced attorney like myself to ensure it aligns with their overall financial goals.

Real-World Challenges and Solutions

Have you encountered any common challenges or misconceptions when advising clients about irrevocable trusts?

One misconception is that irrevocable trusts are only for the wealthy. While they can be beneficial for high-net-worth individuals, they can also serve a purpose for those with more modest assets who want to protect specific assets or plan for future generations.

I recall a case where a young couple was concerned about protecting an inheritance they received for their child’s education. We established an irrevocable trust specifically for that purpose, ensuring the funds would be used solely for the child’s educational expenses, even if unforeseen circumstances arose.

Moreover, I often encounter hesitation from clients who are uncomfortable relinquishing control over their assets. It’s understandable to feel this way. However, it’s important to remember that you can still specify how and when the trust assets are distributed to your beneficiaries. The trustee acts as a fiduciary, bound by legal and ethical obligations to uphold your wishes.

According to a recent study by the American Bar Association, approximately 60% of Americans lack a will or estate plan. This highlights the critical need for individuals to proactively address their financial future.

Steve, what final advice would you offer to our viewers regarding trusts and estate planning?
