“Certainly. One crucial step in estate planning is handling debts and taxes. Ordinarily, this occurs after a court-appointed executor or administrator has gathered and inventoried all estate assets. This involves identifying and paying valid creditor claims.
It’s important to note that creditors have a legal right to be paid from the estate before any distributions are made to heirs or beneficiaries. Consequently, the executor needs to meticulously review all claims and ensure they are legitimate.
Moreover, paying applicable federal and state taxes is also a critical part of this step. Neglecting to fulfill these obligations can result in penalties and interest, further complicating the probate process.”
Navigating Challenges
Have you encountered any particular challenges while handling debts and taxes during probate?
“There was one instance where a family member presented a hefty claim that seemed questionable. After careful investigation, it turned out to be an old debt from a business venture the deceased had been involved in decades earlier. The claimant insisted on receiving payment, creating tension within the family.
Ultimately, we were able to negotiate a settlement with the claimant for a significantly reduced amount based on the age of the debt and lack of supporting documentation. It was a delicate situation that required patience and diplomacy.”

This often leads to complications during probate as assets may need to be distributed according to state law rather than the deceased’s wishes.
