Handling debts and taxes is a critical phase in probate because it ensures that all legal obligations are met before assets can be distributed. Ordinarily, the executor or administrator must first identify and notify all known creditors of the deceased individual.

Consequently, they need to review financial records, bank statements, and correspondence to determine outstanding debts. Valid claims are then paid from estate funds, ensuring that creditors are treated fairly.

Moreover, it’s crucial to file and pay any applicable federal and state taxes on the estate. This can include income tax for the final year of life, estate tax (depending on the size of the estate), and potentially inheritance tax in some states.
