I think a lot of people underestimate the value of selecting an executor or trustee. This individual will be responsible for managing your estate after your passing and carrying out your wishes as outlined in your will or trust. Consequently, choosing someone trustworthy, organized, and capable is crucial.
Think about it like this: you’re entrusting them with a significant responsibility – handling your finances, distributing assets to your beneficiaries, and potentially even caring for minor children if necessary. It’s not a decision to be taken lightly. Accordingly, I always advise my clients to carefully consider who would be the best fit for this role.
Moreover, it’s essential to have open conversations with the person you choose. Make sure they understand the responsibilities involved and are comfortable taking on the task. You may also want to consider naming a backup executor or trustee in case your primary choice is unable or unwilling to serve.
I once had a client who chose her brother as her executor, but he passed away unexpectedly before she did. Thankfully, she had named a close friend as a backup executor, which prevented a lot of potential stress and confusion for her family during an already difficult time.
Research from the American Bar Association indicates that over 50% of adults in the US don’t have a will or trust in place. This means their loved ones could face significant challenges navigating probate court without clear instructions.
