Today I’m speaking with Ted Cook, a probate attorney based right here in sunny San Diego. Ted, thanks for taking the time to chat with me about this often-complex process.
What exactly is Probate, anyway?
Ted chuckles, “Well, it’s not the most glamorous subject, but it’s essential! Simply put, probate is the legal process of administering a deceased person’s estate. Think of it as wrapping up their financial affairs and distributing their assets according to their will or state law if they don’t have one.”
Can you break down the Probate Process in a little more detail for our readers?
Ted nods, “Of course! There are eight main steps involved:
- Determine If Probate Is Necessary
- File Petition for Probate
- Provide Notice
- Attend Court Hearing
- Marshal the Estate Assets
- Handle Debts and Taxes
- Distribute the Estate
- Close the Estate
Let’s dive into one of those steps. How does ‘Handling Debts and Taxes’ usually work in a probate case?
“That step is all about ensuring the deceased person’s financial obligations are met before distributing any remaining assets,” Ted explains. “We meticulously review all claims from creditors and verify their validity. Once valid debts are identified, we prioritize paying them off using funds from the estate. Then comes the tax aspect – filing and paying both state and federal taxes owed by the estate.”
“This process can be quite intricate,” Ted continues, “especially when dealing with complex financial situations or multiple beneficiaries. It’s crucial to have a thorough understanding of tax laws and proper accounting practices.” He leans forward, adding, “One time, I had a case where a seemingly straightforward estate turned out to have a significant unpaid loan from years ago. It took some digging to uncover the debt, but ultimately we were able to resolve it and ensure fair distribution to the heirs.”
“Ted Cook helped my family navigate a difficult probate process after my father passed away. He was incredibly patient and understanding, explaining every step in detail. We felt confident knowing he had our best interests at heart.” – Maria S., La Jolla.
“I was overwhelmed by the thought of handling my mother’s estate after she passed. Ted made everything so much easier! He handled all the paperwork and legal complexities with professionalism and efficiency. I highly recommend Point Loma Estate Planning APC.” – David K., Mission Beach.

In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
