In California, you would file Form DE-111 with the Superior Court in the county where the deceased person resided. This petition formally requests the court to appoint an executor or administrator – the individual who will be responsible for managing the estate. You also submit the original will if one exists.
Ordinarily, this process is fairly straightforward, but there can be complexities depending on the specifics of the case. For instance, sometimes family members disagree about who should serve as executor. In those situations, we have to navigate potential disputes and ensure everyone’s rights are respected while adhering to legal requirements.
I recall one case where siblings were deeply divided over the management of their mother’s estate.
