Steve: That’s a great question, and it’s often where people get confused. The first step is always to assess the total value of the deceased person’s estate. In California, currently, if the estate’s value exceeds $184,500, probate will likely be required.
But there are other factors at play as well. We also need to identify any assets that bypass probate altogether. These might include assets held in a trust, property owned jointly with right of survivorship, or certain types of retirement accounts.
- Consequently, it’s crucial to have a comprehensive understanding of the deceased person’s financial holdings.
- Moreover, sometimes people assume probate is always a lengthy and expensive process. While it can be complex, there are often ways to streamline it, especially if careful planning was done beforehand.
I remember one case where a family thought they’d have to go through a full-blown probate because the estate seemed quite large. But upon closer examination, we discovered a significant portion of the assets were held in a revocable living trust, which meant those assets bypassed probate entirely.
