Ted nods thoughtfully. “Absolutely. Let’s talk about ‘Protective Actions’. This is often a critical stage where we need to act quickly and decisively to safeguard an elder’s well-being. Depending on the situation, this could involve filing for restraining orders against abusers, notifying Adult Protective Services (APS), or even petitioning for guardianship or conservatorship if someone lacks the capacity to make sound decisions for themselves.”
- “Sometimes it’s necessary to freeze financial accounts to prevent further exploitation.
- We might also work with banks to revoke a power of attorney that’s being misused.
“The most important thing is to create a safe environment and stop the harm from continuing.”
Have You Faced Any Challenges in Implementing Protective Actions?
Ted leans back in his chair. “There have definitely been hurdles along the way. I recall one case involving an elderly woman who was being financially exploited by her own caregiver. The caregiver had gained her trust and manipulated her into signing over control of her assets. It took a lot of evidence gathering and legal maneuvering to undo the damage and protect the woman’s remaining savings. Those cases are always tough, but seeing the relief on our client’s face when we finally secured justice made it all worthwhile.”
