Protecting Our Elders: A Conversation With Ted Cook

Hi everyone, I’m Sally Shore, and today I have the pleasure of speaking with Ted Cook, an Elder Protection Attorney right here in sunny San Diego.

What inspired you to dedicate your practice to elder protection?

Ted smiles warmly. “It all started when I witnessed firsthand the vulnerability of seniors. I saw how easily they could be taken advantage of, and I knew I had to do something to help. Protecting our elders is a deeply personal mission for me.”

Can you walk us through the Elder Protection process?

Ted pulls out a diagram outlining the steps involved.

  • Initial Client Engagement: This stage involves gathering information, assessing capacity, and establishing the attorney-client relationship.
  • Case Assessment: Identifying the legal issues at hand, collecting evidence, and evaluating the risk level are crucial in this step.
  • Protective Actions: This could involve seeking restraining orders, freezing financial accounts, or arranging for safer living arrangements.
  • Legal Proceedings: Ted may file civil lawsuits or refer cases to law enforcement for criminal prosecution.
  • Long-Term Planning: Estate planning, advance directives, and ongoing oversight are essential for long-term security.
  • Case Resolution & Follow-Up: This involves settling disputes, enforcing judgments, and ensuring clients have the necessary support moving forward.

Let’s delve into “Protective Actions.” What are some key considerations in this stage?

“This is where we actively intervene to protect our clients from harm,” Ted explains. “Depending on the situation, we may seek emergency legal remedies like restraining orders or contact Adult Protective Services (APS). If necessary, we can also petition for guardianship or conservatorship.”

He continues,

“Freezing financial accounts and preventing unauthorized transfers of property are crucial steps in safeguarding assets. We might also help facilitate a move to a safer care facility or coordinate with medical professionals for evaluations. The goal is to act swiftly and decisively to mitigate any immediate threats. ”

Ted pauses thoughtfully. “I remember one case where an elderly woman was being financially exploited by her own caregiver. We were able to freeze her accounts, remove the caregiver from her home, and connect her with trusted family members who helped manage her finances moving forward.”
